U.S. forwarders and shippers are often surprised to learn that they are required to submit quarterly reports to the Office of Antiboycott Compliance under the antiboycott regulations of the Export Administration Regulations. Whether or not language is reportable can depend on details as small as the inclusion of a comma. Failure to report or proceeding with a request that violates the regulations can result in large penalties. Last year, for example, Pelco, Inc., settled with BIS for $162,000 for failing to comply with the antiboycott regulations (https://efoia.bis.doc.gov/index.php/documents/antiboycott/alleged-antiboycott-violations-2015/1100-a749/file).

If your company requries training in antiboycott controls or a written antiboycott regulations policy, please contact us. You can find more information on the Office of Antiboycott Compliance at https://www.bis.doc.gov/index.php/enforcement/oac.
